				<content:encoded><![CDATA[<p><a href="http://www.toonaripost.com">The Toonari Post - News, Powered by the People!</a></p><p>Houston, U.S.A. &#8211; Last week, a jury awarded Christine Scott of Bakersfield, CA, and her husband, $5.5 million for pain and suffering, medical expenses and economic loss, in a case against C.R. Bard. Ms. Scott had the Bard Avaulta Mesh implant surgery to correct a leaky bladder. After a four year legal battle, Scott&#8217;s case is the first in the nation against the maker of a pelvic mesh implant who claimed Avaulta knew their product was unsafe.</p>
<p>There are thousands of <a href="http://www.pulaskilawfirm.com/practice-areas/medical-device-litigation/vmesh/" target="_blank">vaginal or pelvic mesh lawsuits</a> against several manufacturers across the country. Filings with the Securities and Exchange Commission indicate 47,000 women have had the Avaulta Mesh implanted and 650 lawsuits are pending. Johnson &amp; Johnson, maker of the Gynecare Prolift device, faces more than 1,400 lawsuits who claim the mesh causes significant pain, scarring, nerve damage and organ perforation.</p>
<p>In the Scott case, the mesh began cutting into her colon and tissue continued to grow through the tiny holes in the mesh. Since the surgery, Ms. Scott has had eight corrective surgeries.</p>
<p>Common side effects of vaginal mesh medical devices include pain during intercourse or urination, chronic pain, infection, urinary problems, bleeding, mesh migration, bladder and blood vessel perforation and additional corrective surgeries for repair or removal. The statutory cap had been $350,000.</p>
<p>In 2011, MPM secured an additional $100 million of reinsurance in an innovative and forward-thinking transaction that enhances and fortifies the company&#8217;s financial position and now enables it to keep its premiums fair and stable despite the change in law.</p>
<p>&#8220;This decision will drastically affect payouts in Missouri,&#8221; said Timothy H. Trout, managing director of MPM. &#8220;A payout that would have been no more than $350,000 yesterday could now be more than $1 million. Most insurance companies will now be exposed to this payout unpredictability, and that could likely lead to a significant rate increase for physicians who are with other insurance companies. However, with our company&#8217;s retrocessional reinsurance treaty safely in place, MPM can assure our insureds that the stability of their rates is safeguarded, and MPM&#8217;s future viability remains strong.&#8221;</p>
<p>While many mutual companies pay member dividends, MPM reinvested its surplus to fund its retrocessional reinsurance treaty, a decision that has proved savvy in light of the Missouri Supreme Court&#8217;s ruling.</p>
<p>&#8220;Unfortunately, there is no quick fix for this issue, which is likely to have serious implications for many other Missouri insurance providers and their insured physicians,&#8221; Trout said. &#8220;Historically, the cycle of tort reform damage caps has taken years to resolve.&#8221;</p>
