				<content:encoded><![CDATA[<p><a href="http://www.toonaripost.com">The Toonari Post - News, Powered by the People!</a></p><p>Arkansas, U.S.A. &#8212; Walmart have announced a donation of up to $4.5 million to help 90,000 teachers in the U.S. purchase much-needed classroom supplies. In its fourth year, the Teacher Rewards program will help offset the cost of classroom expenses for teachers across the country. These funds come at a critical time, as U.S. teachers going back to school will often spend their own money to ensure their students have the supplies they need to learn throughout the school year.</p>
<p>Also today, in addition to the Teacher Rewards program, Walmart is sponsoring the &#8220;Teachers Rock&#8221; benefit concert that will take place tonight at the Nokia Theater in Los Angeles and air on August 17 on CBS at 8:00 p.m. ET. Proceeds from the concert will benefit DonorsChoose.org, Feeding America and Teach for America.</p>
<p>&#8220;Each year teachers across the country provide their time, talents and often their own money to ensure students have what they need to be successful in the classroom,&#8221; said Michelle Gilliard, senior director of giving at Walmart. &#8220;Through our Teacher Rewards program we will once again send our nation&#8217;s teachers back to school with the support and resources they need to continue educating the future leaders of our country.&#8221;</p>
<p>Through the Teacher Rewards program, more than 4,600 U.S. Walmart stores, Distribution Centers and Sam&#8217;s Club locations are eligible to select one local kindergarten through eighth grade public school and provide $50 reward cards to 20 teachers. Winning teachers can use the funds to purchase essential items for their classrooms such as paper, folders, binders, clipboards, pens, pencils, crayons and markers. Local stores will begin selecting schools to participate in late August.</p>
<p>The Teacher Rewards program is an example of Walmart&#8217;s ongoing support of education initiatives that help students prepare for their future. In 2011, Walmart and its Foundation donated more than $50 million to fund education programs across the country.</p>

				<content:encoded><![CDATA[<p><a href="http://www.toonaripost.com">The Toonari Post - News, Powered by the People!</a></p><p>In a 7,000-word blockbuster Sunday, The New York Times <a href="http://www.nytimes.com/2012/04/22/business/at-wal-mart-in-mexico-a-bribe-inquiry-silenced.html" target="_blank">reported</a> that Walmart allegedly engaged in a vast campaign of bribery to expand the company&#8217;s Mexico business in the early 2000s, potentially violating U.S. law. The scheme was allegedly overseen by a Walmart executive, Eduardo Castro-Wright, described by The Times as &#8220;the driving force behind years of bribery&#8221; totaling millions of dollars.</p>
<p>Three years ago, Castro-Wright himself gave an <a href="http://www.nytimes.com/2009/05/24/business/24corner.html">interview</a> to The Times in which he offered a somewhat different picture of his leadership style.</p>
<p>Castro-Wright sat for an interview in 2009 as part of The Times&#8217; &#8220;Corner Office&#8221; <a href="http://projects.nytimes.com/corner-office">series</a> in which top executives talk &#8220;about leadership and management.&#8221; The Times asked Castro-Wright: &#8220;What message would you convey in a commencement speech?&#8221; He <a href="http://www.nytimes.com/2009/05/24/business/24corner.html" target="_blank">responded</a>:</p>
<p>&#8220;Here in the United States, and any of the developed countries, I would tend to provide a speech along the lines of what I said before about what makes great leaders — the fact that there&#8217;s no leader who can be called one if they don&#8217;t have personal integrity, or if they don&#8217;t deliver results, or if they don&#8217;t care about the people they lead, or if they don&#8217;t have a passion for winning.&#8221;</p>
<p>Asked about the “most important leadership lesson” he’d learned in his career, Castro-Wright emphasized trust:</p>
<p>&#8220;There&#8217;s nothing that destroys credibility more than not being able to look someone in the eye and have them know that they can trust you. Leadership is about trust. It&#8217;s about being able to get people to go to places they never thought they could go. They can&#8217;t do that if they don&#8217;t trust you.&#8221;</p>
<p>The Times interview ran under the headline &#8220;In a Word, He Wants Simplicity&#8221; about five years after the period in which Castro-Wright had allegedly overseen systematic bribery.</p>
<p>In its front-page story yesterday, The Times quoted former Wal-Mart de Mexico executive Sergio Cicero Zapata alleging how and why Castro-Wright had authorized bribery:</p>
<p>In an interview with The Times, Mr. Cicero said Mr. Castro-Wright had encouraged the payments for a specific strategic purpose. The idea, he said, was to build hundreds of new stores so fast that competitors would not have time to react. Bribes, he explained, accelerated growth. They got zoning maps changed. They made environmental objections vanish. Permits that typically took months to process magically materialized in days. &#8220;What we were buying was time,&#8221; he said.</p>
<p>The meteoric growth of the company&#8217;s Mexican business translated into promotions for Castro-Wright. In 2005, he was appointed head of Walmart U.S., and in 2008 to his <a href="http://www.suntimes.com/business/7910952-420/wal-mart-stores-says-vice-chairman-eduardo-castro-wright-retiring.html">current position</a> as vice chairman of Walmart and CEO of its global ecommerce business.</p>
<p>Walmart <a href="http://www.walmartstores.com/pressroom/news/10704.aspx">announced</a> in September 2011 that Castro-Wright would retire this July. The company&#8217;s bio page that shows up as the second hit for Castro-Wright&#8217;s name on a Google <a href="https://www.google.com/search?q=Eduardo+Castro-Wright">search</a> is now <a href="http://investors.walmartstores.com/phoenix.zhtml?c=112761&amp;p=irol-govBio&amp;ID=47012">blank</a>. Company spokeswoman Ashley Hardie told ProPublica that the page had been taken down after the announcement last September. Castro-Wright is also on the boards of insurer <a href="http://www.bloomberg.com/news/2012-04-23/wal-mart-executive-s-role-on-metlife-board-seen-as-distraction-.html">MetLife</a> and the charity <a href="http://www.care.org/about/board.asp">CARE</a>.</p>
<p>Walmart has posted a <a href="http://www.walmartstores.com/pressroom/news/10879.aspx">statement</a> on the Times piece, saying that it is &#8220;working aggressively to determine what happened&#8221; and that &#8220;if these allegations are true, it is not a reflection of who we are or what we stand for.&#8221; The company informed the Justice Department of an internal investigation in December after it learned of The Times&#8217; reporting, according to the paper.</p>

Four community grants will help meet basic needs like food assistance and rent in Seattle, WA; Fenton, MO; Charlotte, NC; and San Diego, CA, for all eligible service members.</p>
<p>On the national level, Operation Homefront is using the contribution to serve the families of National Guardsmen and Reservists for longer periods before and after active-duty deployments.</p>
<p>With deployments being altered as a result of the withdrawal from Iraq, Guardsmen and Reservists find themselves with lapses in income.  When they return home to an economy where the unemployment rate among recent veterans in the country is significantly higher than civilians, many find themselves without an income for extended periods of time.</p>
<blockquote><p>&#8220;The holidays are over, but the needs of our military families continue,&#8221; said Jim Knotts, President and CEO of Operation Home front.  &#8220;The end of deployments to Iraq and quickening redeployments from Afghanistan means fewer service members are in harm&#8217;s way.</p>
<p>However, there are still many who are answering the call to duty.  Each one of them has a family back home.  Operation Home front is committed to continuing to help the families back home, even beyond the deployments to Afghanistan.&#8221;</p></blockquote>
<p>Operation Home front, a national nonprofit with 24 local Chapters, provides emergency assistance – including food aid, rent and mortgage assistance, and help with car repairs – to active-duty service members of all branches.  The organization&#8217;s policy had been that National Guard and Reservist families were eligible for aid 30 days pre-deployment, during deployment, and 90 days post-deployment.</p>
<p>As a result of the Walmart grant, these families are now eligible for 60 days pre-deployment, during deployment, and 120 days post-deployment.  Based upon demand, Operation Homefront hopes to be able to expand the eligibility even longer.</p>
<p>&#8220;These citizen-soldiers and their families make the same sacrifices as our active-duty military, and also face the difficulty of transitioning in and out of service,&#8221; continued Knotts. &#8220;Walmart has been our steadfast partner in helping military families for years.  Walmart&#8217;s contribution will give these families a bit more breathing room, whether they are facing a financial shortfall while a loved-one is overseas, or trying to find work in today&#8217;s difficult job market.&#8221;</p>

				<content:encoded><![CDATA[<p><a href="http://www.toonaripost.com">The Toonari Post - News, Powered by the People!</a></p><p>In a move to protect their right to pursue individual and class action pay and promotion claims against Wal-Mart Stores  more than 500 former and current Wal-Mart women employees who had been part of a national class action lawsuit have filed a charge of discrimination against the retailer with the U.S. Equal Employment and Opportunity Commission (EEOC) as of Friday, Jan. 27.</p>
<p>That was the deadline for women in five states – Alabama, Arkansas, Georgia, Mississippi and North Carolina – to pursue their claims, according to plaintiffs&#8217; attorneys Joseph Sellers, Cohen Milstein Sellers&amp; Toll PLLC, and Brad Seligman, the Impact Fund, who represent the women.</p>
<p>The vast majority of the EEOC charges – some 430 – were filed in those states since the June 2011 U.S. Supreme Court decision reversing a lower court ruling certifying class action against Wal-Mart. Women in all other states who previously filed class action claims against Wal-Mart, and its subsidiary Sam&#8217;s Club, have until May 25, 2012, to file a claim with the EEOC.</p>
<p>&#8220;The Supreme Court did not give Wal-Mart a free pass to discriminate.  Filing an EEOC claim is one more way current and former women employees of Wal-Mart can assert their rights,&#8221; Sellers and Seligman said in a statement.  More than 12,000 women have contacted plaintiffs&#8217; counsel directly or through the informational website, <a href="www.walmartclass.com" target="_blank">www.walmartclass.com</a>, to discuss pursuing claims of gender-based pay and promotion discrimination.</p>
<p>Even in the five states with the Jan. 27, 2012, filing deadline, women with pay and promotion discrimination charges against Wal-Mart from July 2011-on can file EEOC claims against the company.</p>
<p>&#8220;These EEOC charges are just the down-payment—we expect to file thousands of additional charges by the May 25, 2012 deadline.  We urge women throughout the country who feel they have been discriminated against by Wal-Mart in pay and promotions to log onto the www.walmartclass.com site and register,&#8221; said Seligman.</p>
<p>Regional class action lawsuits on behalf of women plaintiffs who worked in California and Texas region Wal-Mart stores were filed in federal courts in those states in October 2011.  An expanded class action was filed in Texas federal court in January 2012.</p>

The new record, a 3.4 percent increase from 2010, highlights the support of American donors who gave generously despite a continued slow economy.</p>
<p>In its 120th year, after beginning on the wharf in San Francisco in 1891, the Red Kettle Campaign has become a Christmas tradition that utilizes volunteers to ring bells at 25,000 red kettles nationwide. In 2011, The Salvation Army expanded on the Campaign by incorporating new technologies at kettles and hosting national events to inspire giving.</p>
<p>&#8220;In troubling times, we are truly grateful for the generosity of the American donor to support the traditions of the campaign and help The Salvation Army carry on its Mission,&#8221; said Commissioner William Roberts<strong> </strong>, National Commander of The Salvation Army. &#8220;We have been working to expand the Red Kettle Campaign to reach new and young donors, and with continued support, we are able to meet human need in His name during the winter months and year round.&#8221;</p>
<p>In keeping with tradition, the Dallas Cowboys helped The Salvation Army launch the campaign by hosting the 15th annual National Red Kettle Campaign Kickoff at Cowboys Stadium in Arlington, Texas. Grammy Award winning, international superstar Enrique Iglesias performed LIVE, with special guest Pitbull, on a nationally televised stage on Thanksgiving Day, singing to more than 31 million Americans.</p>
<p>The Salvation Army, in partnership with Sky Blue Group, Swift Entertainment and Universal Studios CityWalk, also hosted the second annual &#8220;Rock the Red Kettle Concert&#8221; on December 17 to encourage young Americans to support charitable causes.</p>
<p>With host Mario Lopez of &#8220;Extra,&#8221; popular, Grammy-winning and platinum-selling recording artists such as Honor Society, Greyson Chance, Hanson, Colbie Caillat, Cody Simpson, and Drake Bell performed at Universal Studios CityWalk&#8217;s state-of-the-art &#8220;5 Towers&#8221; concert venue in Hollywood.</p>
<p>World-renowned actor and recording artist Robert Davi made a guest appearance at the concert, following the release of his re-imagined version of the Christmas classic, &#8220;Mistletoe and Holly.&#8221; Proceeds from the song&#8217;s sales supported the Red Kettle Campaign.</p>
<p>Salvation Army bell-ringers manned red kettles at store fronts and in shopping malls nationwide. Corporate partners who helped the Army set a new fundraising record include:</p>
<ul>
<li>Walmart - $41.5 million raised</li>
<li>Kroger - $13.1 million raised</li>
<li>Sam&#8217;s Club - $5 million raised</li>
<li>jcpenney - $3 million raised</li>
<li>Big Lots - $1.4 million raised</li>
</ul>
<p>The Walmart Foundation made a donation of $1 million to the Army as part of its effort to support hunger relief in America. Sam&#8217;s Club and The Salvation Army also partnered with Off the Field, a professional football players&#8217; wives association, to host the fifth annual Dream Drive on December 8. Twenty pre-selected families from The Salvation Army Adopt-A-Family program in 10 cities received $1,000 in gifts from Sam&#8217;s Club for a total donation of $200,000.</p>
<p>The Salvation Army partnered with jcpenney for the third year to bring Christmas gifts to 63,000 children and seniors as part of the Angel Giving Tree Online at jcp.com/angel. Customers could adopt, shop and ship gifts for people in need through<a href="jcp.com/angel" target="_blank"> jcp.com</a>.</p>
<p>Square, which donated credit card readers for The Salvation Army to use in test markets - San Francisco, Chicago, Dallas and New York, helped make giving easier for donors. Sprint also donated smartphone devices to The Salvation Army to mobilize the credit card application.</p>
<p>To raise awareness during the campaign, The Salvation Army also hosted the inaugural World Record Bell Ringing Contest. Twenty-four bell ringers set out to surpass a benchmark of 36 hours of continuous ringing of a hand bell. Three bell ringers, Caleb Stokes and Leilan McNally in Indianapolis, IN and Darrell Tureskisin Springfield, IL surpassed the record and rang a bell in support for 60 hours straight.</p>

But for the best bass pros on the planet February means a hot bite, big bass and the beginning of another exciting FLW Tour season.</p>
<p>The <a href="http://www.flwoutdoors.com/bassfishing/flw/tournament/2012/6747/lake-okeechobee-home/" target="_blank">Walmart FLW Tour on Lake Okeechobee presented by Evinrude</a> will visit Clewiston, Fla., Feb. 9-12for the first tournament of its 17th season. Hosted by Roland &amp; Mary Ann Martins Marina &amp; Resort, the tournament will feature a full field of the world&#8217;s best bass pros and co-anglers casting for top awards up to$125,000 cash in the Pro Division and up to $25,000 cash in the Co-angler Division.</p>
<p>FLW Tour anglers haven&#8217;t competed on Lake Okeechobee since the February 2011 season opener, and <a href="http://www.flwoutdoors.com/community/profile/home.cfm?uid=60686" target="_blank">National Guard pro Scott Martin</a> is eagerly anticipating this year&#8217;s kickoff. The Clewiston resident has fished these waters for years and knows them like the back of his hand. Martin also has some tournament momentum behind him, as well. He won the 2011 Forrest Wood Cup and $600,000 in August on Lake Ouachita in Hot Springs, Ark.</p>
<p>&#8220;The fishing has been phenomenal since the day we left (last year),&#8221; said Martin, who owns five top-10 finishes and one victory on Lake Okeechobee. &#8220;The fishing got better. And it stayed better all throughout the spring and the summer time, and it never slowed down, and now we&#8217;re back into the springtime again and the fish are just bigger. There seems to be more of them and more 30-pound bags weighed in at local events right now than I&#8217;ve ever seen. The potential for having some of the records fall is very likely.</p>
<p>&#8220;I&#8217;m in shorts and a T-shirt as we speak,&#8221; Martin added. &#8220;The water temperatures have been very consistent. We haven&#8217;t had a big cold front at all, so these fish are really going to start spawning and really be active this week.&#8221;</p>
<p>Martin said he expects the tournament to focus on spawning bass and flipping baits, however, he added that anglers will be presented with opportunities to use a variety of techniques and baits. When asked about the Alabama rig, the hot-topic controversial bait system that took the tournament world by storm at last year&#8217;s Lake Guntersville Tour event, Martin offered his opinion with no hesitation.</p>
<p>&#8220;I don&#8217;t think the Alabama rig will be a factor,&#8221; Martin said.</p>
<p>As the reigning Forrest Wood Cup champion, one might think that he has a target on his back and every angler in the field will be looking to dethrone him, but Martin doesn&#8217;t think that&#8217;s the case.</p>
<p>&#8220;This is Lake Okeechobee,&#8221; Martin said. &#8220;There&#8217;s so many good places to fish right now on this lake and so many different ways to catch them that I&#8217;m going to really have to put my thinking cap on and buckle down and find the winning pattern and the winning fish. There&#8217;s going to be lots of guys catch them.</p>
<p>&#8220;Tournaments are tournaments,&#8221; Martin added. &#8220;These guys aren&#8217;t focusing on beating me. Fishing is fishing. You&#8217;ve got to beat the fish. That&#8217;s what it always boils down to. I don&#8217;t think I have a target on my back to say the least. Everybody&#8217;s going to be going against the fish. The guys who fish against the fish are the guys that are going to do well. The guys that fish to try to beat some other angler &#8230; that&#8217;s the wrong attitude.&#8221;</p>
<p>In FLW Tour competition, anglers are also vying for valuable points in hopes of qualifying for the 2012 Forrest Wood Cup, the world championship of bass fishing. This year&#8217;s Cup will be in Duluth/Gainesville, Ga., Aug. 9-12 on Lake Lanier and anglers could win as much as $500,000 – the sport&#8217;s biggest award. Anglers are also vying for the prestigious 2012 Walmart FLW Tour Angler of the Year presented by Kellogg&#8217;s title that will be determined by the most points accumulated over the six Tour Majors.</p>
<p>Anglers will take off from Roland &amp; Mary Ann Martins Marina &amp; Resort located at 109 Central Ave. in Clewiston at 7:30 a.m. Thursday and Friday morning and from the Clewiston Boat Basin at 7:30 a.m. Saturday and Sunday morning. Thursday and Friday&#8217;s weigh-ins will also be held at Roland &amp; Mary Ann Martins Marina &amp; Resort located beginning at 3 p.m. Saturday and Sunday&#8217;s final weigh-ins will be held at the Walmart located at 1005 West Sugarland Hwy. in Clewiston beginning at 4 p.m.</p>
<p>Fans will be treated to the FLW Outdoors Expo at the Walmart on Saturday and Sunday from noon to 4 p.m. prior to the final weigh-ins. The Expo includes Ranger boat simulators, the opportunity to interact with professional anglers, enjoy interactive games, activities and giveaways provided by sponsors, and fans can learn more about the sport of fishing and other outdoor activities. All activities are free and open to the public.</p>
<p>As part of the FLW Tour&#8217;s community outreach initiative, select FLW Tour anglers will be speaking to third-grade students at Eastside Elementary School located at 201 West Arroyo Ave. in Clewiston from 9-10 a.m. Feb. 8. The anglers&#8217; wrapped boats and tow vehicles also will be on display at the school.</p>
<p>Coverage of the Lake Okeechobee tournament will be broadcast in high-definition (HD) on NBC Sports Network when &#8220;FLW&#8221; airs March 18 from 1 to 2 p.m. ET. &#8220;FLW&#8221; is hosted by Jason Harper and is broadcast to more than 559 million households worldwide, making it the most widely distributed weekly outdoors-sports television show in the world.</p>

Acres projects connect existing lands to protect migration routes, provide access for people to enjoy the outdoors and help ensure the future of rural economies that depend on forestry, tourism and recreation.</p>
<p>Acres for America is a 10-year, $35 million commitment that began in 2005 between Walmart and the National Fish and Wildlife Foundation (NFWF) to purchase and preserve one acre of wildlife habitat in the U.S. for every acre of land developed by the company through 2015.  To date, Acres for America has invested in projects in 24 states, protecting more than 687,000 acres.</p>
<p>&#8220;It is estimated that America loses nearly three million acres of open space each year,&#8221; said Jennifer May-Brust, Walmart vice president of realty supplier management and compliance. &#8220;Our strategic partnership with the National Fish and Wildlife Foundation is helping save important wildlife habitats and fits perfectly with Walmart&#8217;s larger goal to bring sustainability into the communities we serve.&#8221;</p>
<p>In the summer of 2011, Walmart expanded its Acres investments to include urban conservation projects inChicago, Los Angeles, New York, and Washington, D.C.  The six awards announced today will support projects in California, Colorado, Florida, Georgia, Hawaii, North Carolina and Tennessee.</p>
<p>&#8220;With these new projects, Acres for America extends into five additional states to protect vital areas for wildlife and people,&#8221; said Jeff Trandahl, executive director and CEO of NFWF. &#8220;These investments will not only benefit endangered species like the Florida panther – they will also expand open space near urban areas and conserve forests and streams along the Appalachian Trail, one of our most treasured natural resources.&#8221;</p>
<p><span style="text-decoration: underline">The 2012 Acres for America projects:</span></p>
<p>Southern Sierra Partnership: Tehachapi Linkage, California</p>
<ul>
<li>While protecting more than 22,000 acres of rare blue oak habitat in the Sierra foothills, this project completes a key 50-mile ecological corridor linking the Sierra-Cascade ranges to the California Coast ranges and the lowlands of the Great Central Valley to the Mojave Desert.</li>
</ul>
<p>Rocky Flats National Wildlife Refuge Expansion: Colorado</p>
<ul>
<li>This project protects 1,334 acres of tallgrass prairie adjacent to the Rocky Flats National Wildlife Refuge and connects to 70,000 acres of locally protected open space, greatly expanding recreation opportunities in metropolitan Denver.</li>
</ul>
<p>Panther Crossing Protection Project: Florida</p>
<ul>
<li>This 1,530-acre property protects a key migratory corridor for the endangered Florida panther, of which less than 165 exist in the wild.  It connects existing panther habitat to the south with 1.5 million acres of new habitat in the Northern Everglades, and will also benefit the American black bear, red-cockaded woodpecker, swallow-tailed kite and snail kite.</li>
</ul>
<p>Almo Tract: Fort Benning, Georgia</p>
<ul>
<li>This 7,550-acre tract in Georgia&#8217;s Fall Line Sandhills is the eastern anchor of a larger 30,000-acre conservation corridor adjacent to Fort Benning. The project protects longleaf pine forest and provides important habitat for the gopher tortoise and red-cockaded woodpecker, among other species.</li>
</ul>
<p>The Palila Protection Project: Hawaii</p>
<ul>
<li>On the Big Island of Hawaii, two protected parcels (4,469 acres) provide critical habitat to the palila (Loxioides bailleui), one of the rarest birds in the world, and contribute significantly to its recovery.</li>
</ul>
<p>Appalachian Trail Habitat Protection Project: North Carolina and Tennessee</p>
<p>Partners: The Conservation Fund, Appalachian Trail Conservancy, Blue Ridge Forever and Conservation Trust for North Carolina</p>
<ul>
<li>This group of seven key parcels collectively protects nearly 13,000 acres of forest and 40 miles of freshwater streams along the Appalachian Trail Corridor, which are home to the imperiled southern Appalachian brook trout, 1,000 species of plants, at least 300 species of birds and 20 species of rare and declining salamanders.</li>
</ul>

				<content:encoded><![CDATA[<p><a href="http://www.toonaripost.com">The Toonari Post - News, Powered by the People!</a></p><p>After years of litigation, a class-action discrimination lawsuit against Wal-Mart Stores Inc. has been rejected by the Supreme Court. Over the last several years, Wal-Mart has been pushed into the spotlight by a series of lawsuits by disgruntled employees. This most recent discrimination case grew from a few disgruntled employees to one of the largest class-action lawsuits in recent memory. Three Wal-Mart associates have come together to try to sue Wal-Mart in a class-action lawsuit concerning discrimination against women in management positions.</p>
<p>The case reached all the way to the Supreme Court before all nine supreme justices sided with Wal-Mart’s contention that each discrimination case is unique to the store in which is allegedly  occurred and should be sought by the individual for any damages due.</p>
<p>This ruling is a big break for Wal-Mart, as they could have ended up paying billions of dollars to the 1.5 million female employees that have worked at the 4,300 Wal-Mart stores across the country since 1998. Theodore J. Boutrous Jr. and Theane Evangelis Kapur, the two main defense lawyers for Wal-Mart, have pointed out that there are numerous success stories of women who started out in entry-level positions and were promoted to various levels of management. Their hiring and promotion policy also specifically prohibits discrimination when determining a candidate for any position, including management.</p>
<p>Betty Dukes, one of the three women who began this lawsuit, argues that during her employment at Wal-Mart she witnessed male associates get promoted, while female associates with similar qualifications were passed up. In her own case, she spoke with upper management numerous times concerning her desire to be promoted, but to this day, she has still not been promoted. She was even demoted after she got change from a register while on the clock.</p>
<p>Dukes felt singled out by this demotion because other associates had done this before, and had never gotten in trouble. She felt that this discrimination was based on her gender, and that other women who work at Wal-Mart had experienced this discrimination as well. Now that the Supreme Court has ruled these discrimination cases must be taken up individually, if Dukes chooses to continue her case, she will have to start all over again and bring action against the specific Wal-Mart where she was employed.</p>
<p>Despite their strong equal opportunity policy, Wal-Mart’s hiring and promotion process is based on the discretion of the management in that particular store. Those with the responsibility of assessing candidates for different positions in their store are instructed to “not tolerate discrimination in employment, employment-related decisions, or in business dealings on the basis of race, color, ancestry, age, sex, sexual orientation, religion, disability, ethnicity, national origin, veteran status, marital status, pregnancy, or any other legally protected status”</p>

<p>In the case of the defendants, they may or may not have been discriminated against.</p>
<p>Although management is supposed to remain unbiased, that does not stop some individuals from breaking from policy and hiring someone based on personal preference instead of for that person’s individual qualifications. Boutrous and Evangelis Kapur have stated that Wal-Mart is not opposed to the three defendants taking their complaints against the particular stores in which the discrimination supposedly occurred. If this discrimination did happen, then the members of management responsible should be reprimanded for not following company policy and they are perfectly justified in seeking compensation.</p>
<p>This chapter of the case is closed, but Wal-Mart may have only opened itself to a large number of small claims by all of the individuals working at Wal-Mart that sided with Betty Dukes. In any case, this ruling will have an important impact on what constitutes a class-action lawsuit, and whether or not big businesses really can be held accountable for their actions.</p>
